This agreement is between you the Subscriber, hereinafter referred to as the Subscriber, and ISP, hereinafter referred to as DRIK ICT LTD, (collectively referred to as Parties). The Subscriber desires to become affiliated with ISP for using services provided by ISP. Therefore, the Parties agree as follows:

• DRIK ICT LTD agrees to allow Subscriber to use computing facilities at Subscriber's site in ISP's service area and to transmit data over the Network, and/or Subscriber's data on ISP's computers, in accordance with the terms of these Subscription rules and DRIK ICT LTD's Acceptable Use policy which follows:
• Any disruptive or destructive traffic of any source is absolutely prohibited. This includes unsolicited electronic mail (spamming), DOS (denial of services) attacks etc. Port scanning; attempting to hack other systems or any other unacceptable behaviour involving use of DRIK ICT LTD network is prohibited. DRIK ICT LTD's decision in regard to what is acceptable or not, is final.
• If any data from any source leaves DRIK ICT LTD and enters any other network, that data must follow the acceptable use rules of the other network (including member networks, regional or backbone networks). It is the responsibility of the Subscriber to comply with these, not ISP's.
• DRIK ICT LTD specifically prohibits any use or display of data or information which could be viewed as racist, sexually offensive, offensive or obscene.
• DRIK ICT LTD shall not be liable for any health hazard or problems otherwise caused by the use or abuse of the services and the equipment.
• DRIK ICT LTD expressly prohibits the re-sale, share or re-distribution of its services. Redistribution of any of its service to another address, unit, house or across a property boundary is strictly prohibited.
• DRIK ICT LTD prohibits illegal software trading and the Subscriber is solely responsible for any legal actions taken against him by third parties on the grounds of copyright infringement. DRIK ICT LTD cannot be held responsible for any such claims from third parties.
• The Subscriber is responsible for controlling his/her Anonymous FTP directory. DRIK ICT LTD routinely patrols these directories and reserves the right to terminate this facility if we encounter illegal usage.
• DRIK ICT LTD reserves the sole right to block or limit usage and bandwith of any Internet based service that impedes, hinders or otherwise degrades the overall network efficiency. DRIK ICT LTD's decisions in this regard shall be final, and not subject to external legal process or scrutiny.
• The subscriber cannot sell or dispose of the equipment provided by DRIK ICT LTD. The equipment shall not be subject to any liens and remains the property of ISP, in terms of this contract.
• The subscriber must be 18 years or older.
• Subscriber shall pay service fees according to the package. All charges are payable in BDT. All service fees are due in advance of service. No credit is given for partial use during the month of termination. The registration charge given during taking the connection is not refundable.
• DRIK ICT LTD has the exclusive right, title and ownership of the connection and all equipment provided by DRIK ICT LTD, including but not limited to ONU, ONU Adapter, TJ Box, UTP & Fiber Patch cord, Fiber Cables, etc. it is the responsibility of the subscriber to maintain such equipment, accessories and connection with proper maintenance and care.
• No complain will be accepted if it is not communicated to official phone number +88029103222 and web ticket through DRIK ICT LTD.com.bd
• 100 % of uptime and bandwidth will not be ensured at shared connection and shared connection will be provided based on 1:8 sharing ratio.
• DRIK ICT LTD will not provide unlimited bandwith to home user through shared packages. All packages are subject to a maximum limit of bandwith.
• DRIK ICT LTD will not be responsible to recompense if the use of internet is disrupted by cutting down of cable, Technical error of upstream natural disasters or any other technical errors.
• If the connection is off for more than 30 days, it will be disconnected permanently and DRIK ICT LTD will uninstall the connection.
• At least 24-48 hours’ time may be required to solve any kind of technical issue.
• No complain will be accepted in case of value added service.
• Transfer charge and 48-72 hours may be required for shifting of connection.
• Under this terms of this Agreement, DRIK ICT LTD is under no obligation to configure any of your equipment / leased equipment. All configurations of your equipment, including router configurations, computer configuration, and the like are subscriber’s sole responsibility.
• The Subscriber shall strictly comply with the applicable Laws, Rules or Regulations imposed by the BTRC or the Government and shall not use the service established under this agreement for any purpose or business which is illegal, unlawful, fraudulent, immoral, inappropriate, offensive, abusive, obscene, threatening in nature, contrary to the national security, endanger with social or economic interest or damage the reputation of DRIK ICT LTD to other Subscribers or in any other way not approved or permitted the Government.
• The Subscriber is solely responsible for protect his/her username and password or other service related information.
• All information exchanged between Parties shall be considered confidential.
• DRIK ICT LTD reserves the right to change these terms and conditions at any time without prior notice.

USE AND DISCLOSURES

• DRIK ICT LTD will not use Personal Information for purposes other than;
  • Providing our products and services; and
  • Providing details of our products and services and upcoming seminars through our mailing list
• DRIK ICT LTD will not disclose subscriber’s Personal Information other than for the purposes of providing our products and services unless required to do so. For example, we may disclose Personal Information to law enforcement agencies, government agencies, courts or external advisers where permitted or required by law.
• Any false information by the Subscriber in any document or in the subscription form gives DRIK ICT LTD right to disconnect, suspend or terminate the services.
• Subscriber shall immediately notify DRIK ICT LTD any change in the information earlier provided by the subscriber failure of which shall entitle DRIK ICT LTD to suspend or terminate the services immediately at its sole discretion
• DRIK ICT LTD will not sell, trade or rent your Personal Information without your prior consent
• DRIK ICT LTD may disclose Personal Information to avoid an imminent threat to a person's life or to public safety.
• All information exchanged between the parties shall be considered

SECURITY OF INFORMATION

We will keep subscriber’s Personal Information secured in our offices and our off-site at our secured records management system. If/when subscriber’s business is completed we may store your usage records and any related personal information at our secured records management system.

CHANGE IN PRIVACY POLICY

DRIK ICT LTD reserves the rights to change or update this privacy policy at any time without prior notice. When updated or amended and the new Privacy Policy will be posted on website. Subscribers are advised to keep themselves updated regarding DRIK ICT LTD’s Privacy Policy through the website www.DRIK ICT LTD.com.bd

DRIK ICT LTD will not process any refund on the following ground :

• No MRC for the month is Refundable for which client have already recharged.
• No MRC will be refundable for the month for which have been billed already.
• Mid-Month Cancellations requests where customer used partial month or Funds.
• In case of MRC recharged in wrong User ID, If any user claims refund within 24 hour, payment will be refunded withing 5-7 working days.
• All services are on a prepaid basis and requires a prior notification as per company policy for discontinuation of service.
